Brain Death and its Legal and Juridical Effects

Brain death is considered as one of the kinds of mercy killing and different ideas about is dependent on different ideas about ethics and morality. Its importance comes from that point it is a subject for different issues like heritage. Time after divorce, capital punishment, Abolishing the precautions, blood money, permission for wives marriage etc. of death and it is clear that if someone has brain death. These issues are applicable investigation of this matter in medical. juridical, political, Social, ethical and philosophical debates is important so that a lot of meetings and seminars are held in all over the world and in developed Countries and there are different reactions toward it. According to the Article of Islamic council about those people who have brain death, today in hospitals, organs of dead people are transplanted to another sick people, while a big share of Islamic jurists consider it illegal, and some of them consider it as a murder and deserve the doer to the capital punishment.
