  • Abstract
    With the purpose of protecting conservation areas, development rights derived from private properties have been restricted by law in many countries including Turkey. In this context, “transfer of development rights” tool is frequently used in the world to compensate property owners for their loss of property and to protect the nature conservation areas using the proceeds from the sale of development rights in such areas where development is completely prohibited or restricted. In this study, firstly, Turkey’s nature conservation areas’ policies in relation to the private property rights were examined. Next, TDR methods are defined and detailed with regard to their operation and implementation in relation to the Turkish legislation and sample project implementations in other countries. In the last section of the study, the applicability of transfer of development rights methods was evaluated in the Turkey’s nature conservation areas. In line with all the reviews regarding the TDR method, it was concluded that implementation of the TDR method under Turkey’s current legislative, and socio-economic conditions is only possible in the long term.
