Abstract
There were no clear and certain rules about marriage and divorcement differently from other areas in Roman law that is the source of modern law in all areas. Since in Rome, a marriage was considered to take place in the society as husband and wife with the intention of living together a lifetime, a marriage was brought about based on the parts’ free will and divorcement was brought about when the parts expressed their own free will that the marriage could not continue. Therefore, as well as there were no rules arranging divorcement in Rome, it is seen that certain laws and mandates were published. In this study, basically, marriage in Roman law, the methods applied in the marriage process and the status of husband and wife in marriage will be dealt with. Also, the divorcement ways between the parts, the reasons, and the precautions taken to prevent divorcement in Rome will be dealt with.
