Abstract :
Today’s economic conditions and the technological developments which have been reached, have made it inevitable to have labour division based on specialization. Owing to the need in working life, the setting of relationships between the main employer and the sub-employer in public establishments has frequently been encountered in practice. The government provides employment due to minimum expense by running workers via contractors in public establishments. However with such an application in public establisments, it is unthinkable to limit or take away the collective and individual rights of workers. In practice, illigal and collusory operations can be well performed between the public employers and sub-employers. For that reason, the judge should have find a solution to the problem without making any distinction between private and public employer in the application of sub-employer by interpreting every concrete event in accordance with the purpose of law regulation.
