IS EQUALIZATION OF WORKING HOURS FLEXIBLE OR ARBITRARY IMPLEMENTATIONS? A REVIEW ABOUT THE BALANCING (EQUALISING) OF WORKING HOURS AND THE OVERTIME WORKING IN LABOUR LAW PRACTICES

Abstract :
Balancing (equalizing) of working hours is a flexible working system which workers could be employed without paying the overtime wages in some weeks even they work beyond the regular working hours. This kind of flexible working system could be only accepted with the condition of the principles that workers should never misuse and their rights should not be impinged upon. Therefore the legislators put some legal restrictions on this subject not to transform from flexibility to arbitrary. But, in practice it is always observed that workers are employed on overtime basis and that the flexibility on the working system has not functioned properly. One day work and another day off working schedule are not related with the implementation of balancing (equalizing) of working hours.
