Abstract :
Lawsuit proceeding begins with recording of a petition given by plaintiff to the court in written proceeding or basic proceeding. First paragraph of Art. 119 of Civil Procedure Law No. 6100 shows the elements of a lawsuit petition. Second paragraph of this regulation shows the sanction of the case of lack of some of these elements. But this regulation (Art. 119/2) is not enough to determine the applicable sanctions to all elements of the petition. So it is necessary to settle applicable regulations in the case of lack of the elements which are not tied to sanction of Art. 119/2.
