ISLAMIC LEGISLATION ASPECT IN NOVEL NISAH HARON

This article is to look at aspects of Islamic law found in modern literary works, Malay novels. This departed from the initial observation which found many researchers studying the aspects of Islamic law in the old Malay law. Based on observations of earlier literary studies, it is clear that traditional literary works are more widely used as a study material. To date, and as far as it is known there has been no study that seriously leverages modern literary works, especially Malay novels investigating aspects of Islamic law. Because of this problem, this article chose to take advantage of two modern Malay novels, the novel Finding Locus Standi and Lentera Mustika by Nisah Haron to analyze the aspects of Islamic law studied. This choice is based on the reputation of Nisah Haron himself who is now known as the current writer who calls for the legal aspect to be emphasized in literary works. For that reason, this study applies the views of Islamic scholars to be an analysis framework that recognizes the aspects of Islamic law as a legitimate and authoritative cultural document. Among the aspects of Islamic law applied is family law which aims to regulate and organize family life such as marriage, divorce, custody, maintenance, and inheritance. This study is also applied in conjunction with the law that aims to organize and arrange the way property ownership, sale and purchase, charge, rent, and loan borrowing. This trend also found that the legal aspects of Islam have been established based on Islamic lunas executed by the government and public acceptance of the implementation of the law as depicted in the novels studied.
