DIRECTING TO SUICIDE (TURKISH CRIMINAL CODE ART. 84)

The crime of suicidal orientation is in Article 84 of the Turkish Penal Code. The article includes three different types of crime with different elements. In the first paragraph, the actions of persuasion, incitement, strengthening someone else s suicide decision, and assisting someone else s suicide in any way were sanctio-ned. In the third paragraph, the incitement of suicide and in the fourth parag-raph, suicide referral and forced actions were sanctioned. In this study, these ty-pes of crime, which are organized within the same article but have different ele-ments and characteristics, will be examined. Problems in the regulation tech-nique of the article may cause some problems in practice in the context of this crime type. In particular, our study aimed to reveal the problematic points regar-ding the mentioned crime types, to provide solutions for the problems that arise in terms of law by giving examples from the doctrine on the discussions and examples of the judicial practices.
