Abstract :
In primary and secondary schools, if the students harm each other, it is unclear who will bear the harm. In this regard, as well as administrative responsibility, there are also responsibilities arising from private law. In this context, the minor who has the power of appeal may have the responsibility for tort and article 369 of the Turkish Civil Code (Law No.: 4721) may have the responsibility of the head of the household. In addition, in private schools, contractual liability arising from a violation of the obligation to protect the child may also be raised.
