Abstract :
The 4th Civil Chamber of the Supreme Court established an interesting and surprising judgment in a decision of 2016. The subject matter of the decision, that a jockey in a horse race had an effect with an unfair verdict on the results. The court of first instance, when the decision was about to made, the expert examination get done and has established the existence of a tort so the verdict established. However, the relevant chamber of the Supreme Court reversed the judgment of the first-instance court. The basis of the decision to break is a short description of the Turkish Language Association about the games of chance. However, the horse race and the betting based on predicting the results of this race (pick six), are different activities. Besides, betting on horse races is not just gambling. In addition, the causal link was not examined in the decision of reversal. The decision of the Supreme Court about the betting on the results of the horse races, also includes consequences for other sports. Because, betting activity is run in almost all sports.
