“SECURE THIRD COUNTRY CONCEPT” AND ARTICLE 74 OF FOREIGNERS AND INTERNATIONAL PROTECTION LAW

Abstract :
The safe third country policy is considered the most popular exception to the prohibition on repatriation. The person who comes from the safe third country and requests for asylum is sent back to the country that enters the category of safe country entry to the country where he has requested asylum. The question of the safe third country is widely accepted as the signatories of the Geneva Refugee Convention of 1951, which recognized the ECtHR s jurisdiction. Foreigners and International Protection Law regulates the issue of a safe third country in Turkish Law. However, LFIP does not rule out which safe criteria are, but instead the criteria are listed. It refers to EU countries and a few other developed countries. Turkey s geographical reservation to the 1951 Geneva Refugee Union because of application of Article 74 to have put the problem arises. The subject of this research consists in addressing the problem of Article 74 of the NPL according to the asylum claimants.
