Abstract :
Not only do the employees work at the workplace, but also some persons who do not directly participate in the production process in today’s world. The legal relationship established by such persons may result from an imperative in education or public law. These workers or students, who are in the same working environment with the employees, are also at the risk of work accidents and occupational diseases.The persons who do not qualify as employees in the workplace are apprentices, trainees, other students in the workplace for educational purposes, students who do not directly contribute to the production process, and prisoners and convicts in the penal institutions. In our study, the legal character of such persons, which legislation they are subject to and the principles regarding benefiting from the accident insurance and occupational disease branch will be examined.
