Abstract :
With the referendum of 2017, the parliamentary system was terminated, and the Presidential system was initiated whereby presidential decrees gained a new status. Because, it has been granted radical changes in the Turkish legal system by giving the Presidency a principal authority to proceed first-hand regulatory action with a constitutional authorization without the need for a code. In the study, Presidential decrees, in the Presidential system, are exami-ned in terms of constitutional framework, legal and systematic aspects and examined within the scope of the principle of inviolability of the legislative power of the Parliament. Within this framework, it was observed that the Pre-sidential decrees did not violate the “inviolability of legislative power” of the Parliament. Thus, the study evaluates whether the legislative power has been delegated with the amendment using verbal and systematic interpretation met-hods in terms of the discipline of the Constitutional Law with a focus on Presi-dential decrees.
