SEIZURE OF CULTURAL PROPERTIES OF SPORTS CLUBS EXHIBITED IN THEIR PRIVATE MUSEUMS

Abstract :
According to Law on Conversation of Cultural and Natural Properties Article 5, the state has ownership in cultural properties. However there are movable cultural properties which are privately owned. Sports clubs are private legal entities and they are able to own movable cultural properties. Also sports clubs can exhibit these properties in their private musems if they obtain permission from the Ministry of Culture and Tourism. In this article the question that needs to be answered if it is possible to seize the cultural properties of sports clubs exhibited in their private museums. According to Execution and Bankruptcy Code Article 82 public properties can not be seized. This rule can not prevent sports clubs’ privately owned cultural properties from being seized because they are not considered public properties under the law. Due to this, it is accepted that sports clubs’ cultural properties in private musems can be seized.
