Abstract :
The agency stretched precedent beyond its obvious application in an effort to support a new policy departure. It has fundamentally redefined what constitutes a sale of electricity. Ultimately, the method by which FERC did this can lead to more confusion among those affected, less precision, and a risk to the continuity of FERC policy.
