Abstract :
The European Court of Justice in Luxembourg was created as the legal institution of the European Union. Cases are brought by the European Commission, by member states, and by individuals and cases may be referred from national courts for clarification from the ECJ. Medical cases are likely to be brought under four Articles of the Treaty of the European Union. 12 cases from 1986 to October, 2000, are used to illustrate the variety of medical cases that have been decided by the ECJ or are still pending.
