Abstract :
The purpose of this paper is to point out that there is not a clear and direct right to enjoy an environment of quality in the European Convention of Human Rights. Nevertheless, the jurisprudence of the Court has played an important role in creating a specific category of a fundamental right to the environment. An interesting interpretation of the European Convention of Human Rights has been done in the judgements quoted in this article expanding the limits of the Convention through a wide interpretation of the “traditional” human rights.
