چكيده عربي :
درجت معظم النظم الدستورية على منح رئيس الدولة فيها سواء اكان ملكاً ام رئيساً للجمهورية ، امتياز العفو عن المحكومين بارتكاب بعض الجرائم الجنائية ، حيث يكون لهم تخفيف بعض العقوبات او اسقاطها كلياً عن المحكومين بموجب احكام قضائية باتة ، وهذا الاختصاص او الامتياز الممنوح لرئيس الدولة يعد من الاختصاصات التنفيذية المهمة ، والتي تعد وبحق تدخلاً واضحاً في عمل السلطة القضائية ، واخلالاً بمبدا الفصل بين السلطات ، بالرغم من وجاهة المبررات التي يقدمها المدافعون عن هذا الاختصاص . مع ضرورة بيان ان هذا الاختصاص اصبح يمارس من قبل رئيس الدولة في النظم ذات التوجه البرلماني اسوة ببقية الاختصاصات بموافقة او بمشورة رئيس الوزراء او الوزير المختص ، بخلاف الحال في النظم الرئاسية التي يكون فيها لرئيس الدولة منح هذا العفو باستقلال كبير .
چكيده لاتين :
Most constitutional systems have given the head of state, whether he is a king or president of the republic, the privilege of pardoning those convicted of some criminal offenses, as they have the right to reduce or drop some penalties completely from those convicted under final judicial rulings, and this competence or privilege granted to the head of state is one of the Important executive competencies, which rightly constitute a clear interference in the work of the judicial authority, and a violation of the principle of separation of powers, despite the justifications provided by defenders of this jurisdiction. With the need to indicate that this competence is now exercised by the head of state in parliamentary-oriented systems, similar to the rest of the competences with the approval or advice of the prime minister or the competent minister, unlike the case in presidential systems in which the head of state has the right to grant this pardon with great independence.
