The issue of the responsibility of the head of state is one of the most important topics, given the sensitivity of the position and the seriousness of the powers the president enjoys. Given the possibility of abuse or abuse of power by the president, the rule of law requires submission to responsibility until good governance is achieved and democracy is effectively embodied, bearing in mind that the principle of responsibility was enshrined in a real and tangible way in the strictest Islamic Sharia. During our analysis of the man-made constitutional texts, we found that the powers exercised by the president do not correspond to a responsibility of the same degree, because the Caliph’s powers, although broad and different, are all covered by worldly and hereafter responsibility. Accordingly, we aspire to devote practical applications to the cases of responsibility of the head of state, directly and indirectly, until we reach the realization of the concept of good governance and the rule of law defined by Islamic Sharia.
