Bankruptcy crimes are among the most important crimes prevalent in the field of business: the Algerian legislator took a large step towards protecting the creditors of the bankrupt company, as it established exceptional rules for the liability of the managers of joint stock companies and limited liability companies in the event of their embezzlement and concealment of the funds of the company they manage and squandering. The legislator has imposed criminal penalties on the facilitators when they commit the crimes of fraud, bankruptcy and negligence. Therefore, this research will focus on two issues: the first relates to the elements of bankruptcy crimes, and the second relates to follow-up procedures and penalties in bankruptcy crimes.
