The opinions of the jurists were divided on the issue of saying negative contribution or by abstaining, some of them refused to say that there is a negative contribution according to the principle of absolute borrowing, where it is required that the act of the partner with assistance be positive, and some of them went to say that there is a negative contribution according to the principle of relative borrowing between the actor and the partner with assistance. It is not required that the act of participation be positive, which is the focus of this research, by reviewing the most important jurisprudential opinions and legal texts, as well as court rulings, thus reaching the position of the Algerian legislator regarding the negative contribution in all its forms.
