الدور المساعد للقاضي الوطني في مجال التحكيم التجاري الدولي: دراسة حالة المساعدة في تعيين المحكمين

The term impasse in the formation of the arbitration court expresses the natural result of the existence of difficulties before the convening of the arbitration litigation leading to the impossibility of forming this court. This impasse will lead to a fundamental threat to the arbitration system, which necessitates saving this system by finding a legal solution that would allow the formation of the arbitration court. Therefore, the legislator allowed the party who is interested in expediting to refer to the national judiciary in order to obtain a judicial order to appoint the arbitrator and the formation of the court, and from here the judicial system defined the so-called assistant judge. This study examines the jurisdiction of this judge at the stage of appointing arbitrators in terms of the nature of this jurisdiction and how it is exercised.
