The non-financial rights of the war dead - a comparative legal jurisprudence study-

This study discusses the issues related to Non Financial Rights for Killed People in War: A Comparison Fiqeh Study It deals with the right of the dead to have a proper washing, shrouding, funeral prayer and burial. It also deals with the mangling and torture of a dead body and the necessity for respecting the sacredness of the dead. Then the study moves to talk about the acceptability and legitimacy of exposing photos of dead bodies to provoke the public opinion. Another important issue discussed, is the right of handing over the corpse of the dead to their countries and families, even across borders. Following, is the problem of numbered graves, where the Israeli occupation authorities keep the bodies of Palestinians. The study concludes that both Islamic Fiqh and the Human International Law both assure the rights of the dead to be respected and honored even during war.
