The effect of the victim's satisfaction on the criminal responsibility of the offender - a jurisprudential study compared to the Jordanian Penal Code -

The research studies the effect of the victims’ consent on the criminal’s responsibility in the crimes of: murdering, miscarriage, stealing, adultery and qathef. In the first chapter, the study defines the consent according to both jurisprudence and law. The study also highlights the effect of the victims’ consent on the criminal’s responsibility in the crimes of: murdering, miscarriage, stealing, adultery and qathef according to the Islamic Shari’a and the Jordanian criminal law. The research concludes that according to Islamic Shari’a there is no effect for the consent of the victim in the crimes of murdering, miscarriage, and adultery, while the victim’s consent does have an effect in the crimes of stealing and qathef as it releases the criminal from penalty. It also concludes that the Jordanian criminal law corresponds with the Islamic sharee’a except for the crime of adultery as the victim’s consent releases the criminal from penalty.
