هذا البحث يتناول المقال لا. 308 من قانون العقوبات الأردني ، ثم شرح هذه المادة ، وتوضيح الحكم القضائي ومعاقبة الاغتصاب الجنسي في الشريعة الإسلامية وقانون العقوبات الأردني. كما تضمن البحث توضيح الهدف من وقف تنفيذ العقوبة في المادة رقم. 308 ، وبيّن شروط وقف التنفيذ كما وردت في نص المادة رقم. 308- كما أوضح البحث أسباب رفض تنفيذ العقوبة والعقوبة الجنائية. كما أوضح البحث الحقوق المسلوبة في الإسلام. وأخيراً ، تقديم الحلول المقترحة للمشرع الأردني بدلاً من تطبيق المادة رقم. 308.
چكيده لاتين :
This research deal with the article no. 308 of the Jordanian penal law, then explain this article, and clarify the jural judegment and punishment of sexual rape in Islamic law and in the Jordanian Penal law. Also, the research include clarify the aim of stopping the punishment execution in article no. 308, and stated the conditions for stopping the execution as mentioned in the text of article no. 308. As well as, the research explained the reasons behind refusing the punishment execution and the criminal punishment. Also the usurped rights in Islam also clarified within the research. Finally, provide suggested solutions to the Jordanian legislator instead of applying article no. 308.
