Conditions of the diligent between rooting and renewal - a fundamental study in the curriculum and content -

The study dealt with the statements of the fundamentalists about the conditions of the mujtahid and the analysis of their methods; To facilitate comparison between them in mentioning the conditions of the mujtahid and its impact on ijtihad, and studying the renewal that took place in the conditions of the mujtahid in the method and content. The study showed that the conditions of the mujtahid according to the fundamentalists, starting with al-Shafi’i, were the most detailed and specialized, then there was a noticeable softening of the conditions of the mujtahid in the eras of tradition, especially according to Al-Ghazali and those who followed his method, which proved that there is no correlation between strictness in the conditions of the mujtahid and the cessation of ijtihad. The study showed that Al-Shatibi created a new method by dividing ijtihad, reducing the number of conditions and adding the condition of knowing the purposes of Sharia in detail, and leniency in the conditions of the mujtahid in the ijtihad that cannot be interrupted, as it is easy for the mujtahid. The study clarified the agreement of the contemporaries on the necessity of ijtihad in the present era, despite the difference in their methods in expressing the conditions of the mujtahid, and that the conditions for the contemporaries are conditioned by the ancient fundamentalists, with a change in the wording and arrangement.
