The objection of others in the Jordanian Shari’a Procedures Law No. 11 of 2016 AD, an applied study

The study aimed at examining one of the unusual methods of appealing judgments (objection of others), which is permitted by law for every person who was not represented in the case, and the judgment issued affects his rights. , with a mention of the applied models from the reality of the Sharia courts and the decisions of the Sharia Courts of Appeal. It also clarified in the second topic: the effect of submitting an objection, its acceptance and its duration, and when it becomes final, the procedures of the objection case and the defenses that are received in the case of objection of others of its different types. The study resulted in several conclusions, the most important of which are: First: The objection of others is one of the unusual methods of appealing judgments that the law allows for every person who was not an opponent, representative or interfering in the case, and the judgment affected his rights. Second: It is noted that the objection of a third party is directed by a person outside the litigation to the judgment issued in it in order to prevent the harm that may befall him. It is an appeal by a third person objecting with the aim of reversing or amending the judgment, and the judgment issued in the objection of a third party is invalidated from the judgment objected to only by the party that belongs to the objector, unless the article of the aforementioned judgment is indivisible, in which case the judgment shall be nullified as a whole.
