بررسي حمايت هاي قانون و حقوق اسلامي از مادران باردار

تحقيق حاضر با رويكر توصيف-تحليلي به بررسي حمايت هاي قانون و حقوق اسلامي از مادران باردار پرداخته است، مادران در دوران بارداري در قوانين مدني چندان مورد بحث قرار نگرفته‌اند و تنها در برخي موارد از مزايايي برخوردار شده اند، در قوانين جزايي نيز حمايت از مادران باردار بيشتر معطوف به حمايت از جنين است و نسبت به خود مادر چندان توجهي صورت نگرفته است، البته قانون حمايت دولت از مادران در دوران باردارى و شيردهى در سال 1374 به تصويب مجلس شوراى اسلامى رسيد و تسهيلاتي براي مادران در زمان حمل و شيردهي لحاظ نموده است. در قوانين و احكام اسلامي نيز حمايت ها و تخفيف هاي عبادي و احكامي براي مادران در زمان حمل صورت گرفته است،با استناد به آيه 185 سوره بقره و قاعده عسر و حرج مادران باردار از اجراي برخي احكام عبادي و قضايي معاف هستند و برخي حمايت هاي ويژه مانند نفقه دوران حمل بعد از طلاق نسبت به آن ها اعمال شده است.
