انتخابات از جمله شاخصه هاي مهم سنجش دموكراتيك بودن يك نظام سياسي محسوب مي شود. مردم از طريق سازوكار انتخابات مي توانند حقوق فطري و طبيعي خود را در جامعه در قالب انتخاب نوع نظام و قواعد حاكم بر آن و با انتخاب نمايندگان خود به منصه ظهور برساند كه ممكن است در اين امر جرايم و تخلفات انتخاباتي با عناوين متعددي توسط متصديان امر انتخابات، راي دهندگان و يا اشخاص عادي تحقق مي يابد. اين پژوهش به بررسي سياست جنايي ايران در خصوص جرايم انتخاباتي با تاكيد بر فضاي مجازي پرداخته است. روش تحقيق اين پژوهش به صورت نظري- كتابخانه اي مي باشد. سوال اصلي اين است كه سياست جنايي ايران در خصوص جرايم انتخاباتي در بستر فضاي مجازي چه مي باشد؟ پس از بررسي و مطالعات صورت گرفته ملاحظه گرديد سياست جنايي ايران در موارد متععدي شاهد سردرگمي و ابهام در عملكرد نظام حقوقي است كه سبب فقدان يك اراده راسخ در جهت پيشگيري از جرايم انتخاباتي و در نتيجه به عدم برنامه ريزي دقيق در همه ابعاد باز مي گردد. نتيجه آنكه بايد با عزم جدي نظام حقوقي ايران در بازنگري اساسي و نگاه خود به مقوله انتخابات و افعال بزهكارانه (ضمن تصويب قانون واحد و جامع انتخابات) شاهد جرم¬انگاري¬ها و مجازات¬هايي خردمندانه و معقول باشيم كه اين موضوع محقق نمي¬گردد مگر آنكه سياست جنايي روشن، جامع و برگرفته از تجربيات نظام¬هاي حقوقي متمدن و روز جامعه بين¬الملل موردنظر قرار گيرد.

The result is that, with the serious determination of Iran s legal system to review its basic views and its views on the issue of election and delinquent acts (along with the adoption of a single and comprehensive election law), we must see wisdom and reasonable sanctions and penalties that will not be realized. Unless a clear, comprehensive criminal policy is drawn from the experience of civilized legal systems and the day of the international community.
