مالكيت فكري پيش نياز اقتصاد دانش بنيان: بررسي تطبيقي حقوق مالكيت از منظر نهادگرا و اقتصاد اسلامي با تاكيد بر حقوق فكري

Intellectual property as a prerequisite for knowledge economy: Comparative study of property rights from the Islamic economy and institutional perspectives with an emphasis on the intellectual rights

مفهوم حقوق مالكيت فكري بر حسب طبيعت پوياي خود يكي از پرتحول¬ترين حوزه¬هاي حقوقي و اقتصادي در عصر كنوني به شمار مي¬آيد. در اين پژوهش سعي شده تا ويژگي حقوق مالكيت فكري در اقتصاد نهادگرايي و فقه اقتصاد اسلامي بررسي شود. نتايج پژوهش نشان مي¬دهد، در اقتصاد نهادگرايي حقوق مالكيت يكي از نهادهاي اقتصادي است كه تعريف و اجراي آن آثار مهمي بر اقتصاد دانش بنيان دارد، و با ورود به عصر اقتصاد دانايي، تعريف دقيقي از حقوق مالكيت فكري و اجراي آن، براي حمايت از دانش و نوآوري¬هاي حاصل از پژوهش مي¬تواند بستر مناسبي براي توسعه و پيشرفت جامعه ايجاد كند. درفقه اقتصاد اسلامي دو نظريه مختلف پيرامون حقوق مالكيت فكري وجود دارد، برخي عقيده دارند كه مالكيت فكري موضوعي نيست كه قابل تطبيق بر موضوعات فقهي باب عقود باشد و از اين رو آن را به رسميت نمي¬شناسند، و برخي ديگر معتقدند كه مي¬توان بر اساس چارچوب فقهي شيعه آن را به رسميت شناخت. نتايج نهايي مقاله نشان مي دهد، يكي از الزامات پيشرفت علم و فناوري و داشتن اقتصاد دانش بنيان، وجود قوانيني براي حمايت از مالكيت فكري مي باشد،

The concept of intellectual property rights is now one of the most popular legal and economic fields in terms of its dynamic nature. In this research, we have tried to study the characteristic of intellectual property rights in the writing economics and Islamic economic jurisprudence. The results of research show that in the institutional economics the property rights is one of the economic institutions whose definition and implementation have the significant effects on the knowledge economy and by entering the era of knowledge economy, a precise definition of intellectual property rights and its implementation, in support of the knowledge and research innovations, can provide an appropriate ground for the improvement and development of society. There are two different views on intellectual property rights in the Islamic economic jurisprudence. Some believe that intellectual property is not an issue that can be applied to jurisprudential issues of the contracts and thus they do not recognize it, while others believe that it can be recognized based on the Shiite jurisprudential framework. The final results of the paper indicate that one of the requirements for the progress of science and technology and having a knowledge economy is the existence of laws to protect intellectual property.
