با پيدايش اينترنت و فضاي مجازي حجم مبادلات الكترونيكي در مدت كوتاهي افزايش يافته و سيستم هاي جديد به سرعت جايگزين سيستم هاي سنتي شده است. توسعه تجارت الكترونيكي و راهيابي فعاليت هاي تجاري به اينترنت موجب شده، شركت ها استفاده از نام دامنه را به عنوان يكي از راه هاي آسان و تاثير گذار به منظور شناسايي خود برگزينند. بنابراين نام هاي دامنه به عنوان يك عنصر مهم در اطلاعات مربوط به دسترسي شركت ها تلقي مي شود. و بالتبع نقش آن در مبادلات تجاري و معاملات بدليل ويژگي خاص از اهميت فوق¬العاده برخودار است. نام هاي دامنه اشكال سهل الوصولي از آدرس هاي اينترنتي براي پيدا كردن وب سايت ها هستند .و از ديدگاه حقوقي ارتباط تنگاتنگي با حقوق مالكيت فكري دارند، پس بررسي و قياس ماهوي و شكلي آن با ساير مصاديق حقوق مالكيت فكري مي تواند كمك شاياني به شناسايي ماهيت حقوقي و آثار اين پديده جديد در حوزه حقوق نمايد. زيرا نام دامنه در برقراري ارتباطات تجاري ازاهميت بسزايي برخوردار است ، از ايت رو پاسخگويي به مسائل حقوقي مرتبط و اختلافات و تزاحمات آن با ديگر مصاديق حقوق مالكيت فكري مانند علامت تجاري، نام تجاري و ... در جهان ضروري مي¬نمايد. مقاله حاضر درصدد اثبات آن است كه با تبيين و تحليل ماهيت حقوقي نام دامنه در حوزه حقوق مالكيت فكري اين نهاد جديد را به عنوان يكي از دارايي¬هاي فكري بررسي و معرفي كند.

With the advent of the Internet and cyberspace in a short time the volume of electronic transactions are increased and new systems are replacing whit traditional systems quickly . Development of electronic commerce and the entrance of trade activities to the internet has made companies to use the domain name as an easy and effective way to identify their pick. . In other words domain names are as an important element in achieving the company’s information. . As a result, the role of domain name in trademark and transactions is due to its specific features has a particular importance. Domain names of Internet addresses are easy ways to find web sites it used to be. Domain names from a legal standpoint are closely related to intellectual property rights therefore inspecting it and compare it as procedural and substantive aspects with other instances of intellectual property rights can be helpful in identifying the nature of its legal nature and its effects. According to the above and the importance of the domain name, the domain in establishing business relationships, responding to legal issues related to domain name and its disputes and interference with other instances of intellectual property rights such as trademarks are necessary. The present article is explaining and analyzing the subject which is spoken about above, and is In seeking to inspect and prove the legal nature of domain name rights and its close relationship with intellectual property rights as one of the intellectual assets.
