چكيده
يكي از حقوق اساسي و بنيادين در حوزه حقوق خانواده حقوق كودك مي‌باشد. حمايت از حقوق كودك در منابع اسلامي و قوانين كشورها و اعلاميه جهاني حقوق بشر و كنوانسيون حمايت از حقوق كودكان مورد توجه قرار گرفته است. در اين نوشتار تلاش شده است بعد از مفهوم شناسي و بررسي پيشينه حقوق كودك در جهان و اسناد بين‌المللي و اسلام به اين سؤال پاسخ داده شود كه پايهريزي تنظيم و تشريع حقوق كودك بصورت جامع و كامل بدون نقص و كاستي در كدام نظام حقوقي ارائه شده است؟ برآيند اين تحقيق نشان ميدهد كه جايگاه حقوق كودك و پرداختن به همه ابعاد و زواياي آن در آموزه‌هاي قرآني نسبت به نظام حقوق بشري از سطح فاخرتر و برتري برخوردار است زيرا در نظامهاي حقوق بشر از جمله كنوانيسيون حقوق كودك كه شالوده آخرين تلاش‌هاي انسان قرن بيست و يك در عرصه بين‌الملل مي‌باشد برخي از حقوق اصلي كودك همانند حقوق معنوي را ناديده گرفته است درحالي كه قرآن كريم 1400 سال قبل به تمام ابعاد و زواياي آن توجه داشته است پس ميتوان گفت پايهريزي و تنظيم حقوق كودك بصورت جامع در نظام حقوقي قرآن ارائه شده است آنهم در شرايطي كه كودكان انسان محسوب نميشد و جنبه ماليت داشت و خريد و فروش ميشدند از همه مهمتر از ابتداييترين حق، كه حق حيات است محروم بودند و زنده به گور ميشدند و دورههاي تحقير و تنيبه را سپري نمودند. تشريع و حمايت از حقوق كودك در چنين شرايطي، بدون الگوگيري از ديگر نظامهاي حقوقي در واقع از اعجاز و شگفتي علمي قرآن محسوب ميشود.

Abstract:
One of the fundamental rights in the field of family law is the rights of the child. The Islamic resources, the governing laws of the countries, the Universal Declaration of Human Rights and the Convention on the Protection of the Rights of the Child have all paid attention to protect the rights of the child. This article, after having conceptualization and review of the literature of the rights of the child in the world and in the international documents and Islam, attempts to answer this question that which legal system does provide the legal basis for the regulation and codification of the rights of the child in a comprehensive and complete manner? The conclusion of this study shows that the Quranic doctrines, in terms of dedicating rights to the child and addressing all aspects of it, are far better and superior to the human rights system. Because in human rights systems, such as the Convention on the Rights of the Child, which is the last initiative of 21st century human effort in the international arena, some of the main rights of the child have been ignored, such as intellectual property, while the Holy Quran 1400 years ago has paid attention to its all aspects and angels. Therefore, we can say that the foundation and regulation of the rights of the child are comprehensively presented in the legal system of the Qur an. Islamic gave them the due rights at a time when they we were worthless, bought and sold and dehumanized. Most importantly, at that time they were deprived of the very basic right, their right to life, and they used to be buried alive. They had tough times of contempt and denial. Legalizing and protecting the rights of the child in such a situation, without the imitation of other legal systems, is in fact a miracle of the Qur an and a scientific wonder.
