Import standards of the pharmaceutical industry in Iran,Islamic Approach

تجارت يكي از اركان مهم در زندگي انسان است كه شكل اوليه آن با داد و ستد كالا با كالا (پاياپاي) صورت گرفته است. تجارت نيز همگام با پيشرفت علم و تكنولوژي در دنياي مدرن، روند رو به رشد داشته است به طوري كه كشورها در تبادل لحظه به لحظه كالاهاي توليدي و خريد نيازها هستند. در دنياي تجارت و سرعت بين الملل، دارو و تجهيزات پزشكي از اهميت مضاعفي برخوردار است. پويايي جوامع به سلامت افراد آن وابسته است كه براي تحقق اين امر استفاده از كالاهاي پزشكي و دارو ها اجتناب ناپذير است. به همين منظور در اين تحقيق تلاش شده خريد و واردات دارو به كشور ايران با استانداردهاي معاملات از نگاه اسلام بررسي و تطبيق داده شود به گونه اي كه سعي شود علاوه بر منفعت دنيوي و رفاه عمومي، رضايت خداوند و پياده سازي قوانين الهي نيز در اين راستا محقق گردد. روش تحقيق كتابخانه اي و با استفاده از تحليل محتواي قواعد فقه اسلام و كاربرد ميداني آن در تامين نيازهاي داروئي و تجهيزات پزشكي كشور مي باشد. نتايج پژوهش نشان داد، جمهوري اسلامي براي تنظيم واردات نياز به رعايت قوانين بالا دستي از جمله قانون اساسي و قواعد فقه اسلام دارد. قواعد فقهي زيادي مي تواند ورود دارو و تجهيزات بيمارستاني را در تجارت بين الملل تنظيم نمايد. برخي از اين قواعد، عبارت اند از: قاعده نفي سبيل، قاعده احترام جان و مال مسلمان، قاعده تعذر وفا به مدلول عقد، قاعده تلف مبيع، قاعده لا ضرر، قاعده عدالت و انصاف، قاعده نفي غرور، قاعده نفي غرر، قاعده الزعيم غارم، قاعده رجوع جاهل به عالم

Library research methods and using content analysis and application of the rules of Islamic jurisprudence in the field of pharmaceutical and medical supply needs of the country. The results showed that the Islamic Republic to manually import settings need to adhere to the above rules, including the constitution and rules of jurisprudence. Many legal rules medicine and hospital equipment can login to regulate international trade.
