چكيده فارسي :
فرمول هاي كلي در فقه را قواعد فقه مي نامند. برخي از قواعد فقهي در قراردادها بكار مي روند. قواعد فقهي كسب وكار با موانعي روبرو مي شود. فقهاي اسلام در باب معاملات دو بحث معاملات باطل و مكاسب محرمه را طرح كرده اند و از قبيل غش، ربا، غصب، غرر، ابهام، رشوه، نجاسات، منفت غير حلال و ... را ممنوع كرده اند. نويسندگان كتب قواعد فقه مباحثي نظير قاعده حرمت اكل مال به باطل، قاعده حرمت ربا، قاعده منع اجتماع عوضين، قاعده منع ارتشاء، قاعده نفي غرور را در ابواب شروط و عقود و ايقاعات مطرح و بحث نموده اند. سوال اين است كه آيا اين قواعد و احكام فقهي در حوزه كسب و كار و كارآفريني در ايران مي توان به كار گرفت و قراردادهاي كسب و كار ممنوع را تعيين كرد؟ اين پژوهش با تحليل مضمون قواعد و فرمول هاي فقهي سعي دارد قواعد فقهي و احكام شرعي را در حوزه كسب و كار به كار برد و با تبيين مصاديق و قلمرو قواعد فقهي به قواعد اقتصاد اسلامي و خطوط منع شرعي حاكم بر كسب و كار دست يابد. روش پژوهش، مطالعات كتابخانه اي است و اعتبار اجتهاد در اسلام پژوهش اعتبار سنجي شده است. توصيه كاربردي پژوهش، آشنائي كارافرينان ايراني و مراكز آموزشي با احكام و قواعد ممنوعه در فقه اقتصادي، قراردادهاي تجاري و كسب و كار است.

General formula jurisprudence is called fiqh rules. Some legal rules used in contracts. Legal rules to be hampered business. Islamic theologians talk about the transaction null and void transactions have your plan and holy Makasib such as fainting,usury,extortion,Gharar,ambiguity,bribery,uncleanness,suppress symptoms and have banned non-solvent. The authors of the books of fiqh rules topics such as rule of prohibition of eating the wrong property,the principle of prohibition of usury,bilateral social prohibition,the prohibition of bribery,provisions and contracts and Rhythmic Rule pride in chapters have raised and discussed. The question is whether the rules and jurisprudence in the field of business and entrepreneurship in Iran can be used to set the banned business contracts? This study analyzes the content of legal rules and formulas tries to legal rules and legal provisions in the field of applied business rules and clarify the facts and the scope of the legal rules governing the legal ban on Islamic economics and business lines to achieve. The study,library studies and the validity of Ijtihad in Islam is validation study. Research and practical recommendations,acquaintances and educational centers with the laws and rules of the banned Iranian entrepreneurs in economic law,commercial contracts and business.
