The function of endowment in realizing intergenerational justice

عدالت سابقه‌اي به قدمت تاريخ بشر دارد. يكي از وجوه عدالت كه اخيرا در افق ديد انسان اهميت پيدا كرده، «عدالت بين‌نسلي» است. يكي از راهكارهاي تحقق عدالت بين‌نسلي در دين مبين اسلام، سنت نيكوي وقف است. ماهيت وقف بر‌استمرار و دوام مال موقوفه در طول زمان و استفاده نسل‌هاي بعدي از آن، دلالت مي‌كند و با كاركرد‌هاي مختلفي كه دارد از جمله: «صدقه جاريه» بودن، مصداق «الخيرات» بودن، تنوع در نيات متعالي واقفين، توسعه مالكيت عمومي، داشتن شرط دوام، عدم جواز بيع وقف إلّا در موارد خاص و...»، عدالت بين‌نسلي را محقق مي‌كند. اين مقاله ابتدا به تعريف وقف و عدالت بين‌نسلي مي پردازد و سپس با طرح انواع كاركردهاي وقف در تحقق عدالت بين‌نسلي وقف را به عنوان يكي از راهكارهاي عدالت بين‌نسلي معرفي نموده و با بهره گيري از آموزه هاي ديني و سيره پيامبر و معصومين: و همچنين تجارب تاريخي آن را به اثبات مي رساند.

Justice has a history as old as human history. One aspect of justice is intergenerational justice . Intergenerational justice has recently become important in the horizon of human vision. In the religion of Islam,, one of the ways to achieve intergenerational justice is the good tradition of endowment. The nature of the endowment is such that it indicates the continuity and durability of the endowment over time and for the use of the next generations. And the nature of endowment, with its various functions (including: being a current charity , being an example of Al-Khirat , diversity in the noble intentions of the endowment donors, development of public ownership, having a condition of stability, not allowing the sale of endowment except in special cases, etc.), brings about the realization of intergenerational justice. This article firstly defines the terms endowment and intergenerational justice. Then, by examining the various functions of endowment in the realization of intergenerational justice, introduces the issue of endowment as one of the solutions of intergenerational justice. Also, this article proves its historical experiences by using the religious teachings and life of the Prophet and the innocents.
