بررسي حقوقي ارتباط بنگاه هاي اقتصادي و نظام بانكي و نقش آن بر اقتصاد

Legal examination of the relationship between economic enterprises and the banking system and its role on the economy

در اين پژوهش، تلاش شده است تا تفاوت بين بازار پولي و سرمايه‌اي مورد بررسي قرار گيرد و اهميت بازار سرمايه‌اي در كشورهاي در حال توسعه به همراه نقش سرمايه‌گذاري در بخش خصوصي، شركت‌هاي سهامي، شركت‌هاي دانش بنيان و انديشه‌هاي نو بررسي شود. اين مطالعه به اين دليل است كه سيستم تأمين مالي بانكداري اسلامي، در مقابل سيستم‌هاي بانكداري آنگلاساكسون و آلماني، نقش مهمي در اين زمينه ايفا مي‌كند. بازار سرمايه‌اي در نظام اقتصادي، به رشد اقتصاد سرمايه‌اي و كاهش وابستگي به فروش نفت در كشور كمك مي‌كند. يكي از نكات حائز اهميت در اين پژوهش، ارائه راهكارهاي مشاوره‌اي و استفاده از تخصص كسب و كارها توسط بانك‌ها در زمينه توجيه اقتصادي و ارائه راهكارهاي تامين مالي، مديريت ريسك، مديريت پروژه و اعتبارسنجي است. همچنين، شركت‌ها و بنگاه‌هاي اقتصادي قبل از ورود به عرصه‌ي اقتصادي و پس از تاييد فرايندهاي لازم، مي‌توانند تسهيلات بانكي دريافت كنند يا پروژه‌هاي خود را آغاز كنند تا بهبود و توسعه شركت‌ها را به همراه داشته باشند و در عين حال از متضرر شدن احتمالي جلوگيري شود. به علاوه، اين تدابير مي‌تواند بانك‌هاي كشور را ترغيب به تغيير رويكرد خود براي تبديل به نظام بانكداري اسلامي كند تا از مداخله مستقيم در نظام اقتصادي جلوگيري شود.

In this research, an attempt has been made to investigate the difference between monetary and capital market and to examine the importance of capital market in developing countries along with the role of investment in the private sector, joint-stock companies, knowledge-based companies and new ideas. This study is because the financing system of Islamic banking, in contrast to the Anglo-Saxon and German banking systems, plays an important role in this field. The capital market in the economic system helps to grow the capital economy and reduce dependence on oil sales in the country. One of the important points in this research is the provision of consulting solutions and the use of business expertise by banks in the field of economic justification and the provision of financing solutions, risk management, project management and validation. Also, companies and economic enterprises before entering the economic arena and after confirming the necessary processes, can receive bank facilities or start their projects to improve and develop the companies and at the same time avoid possible losses. . In addition, these measures can encourage the country s banks to change their approach to convert to the Islamic banking system in order to avoid direct intervention in the economic system.
