قتل عمد، به معناي گرفتن جان ديگري، از روي عمد و با سوء نيت است و مرتكب را با حكم مجازات اين جرم كه قصاص و در مواردي ديه و حبس است، روبرو مي كند. تنها در صورتي كه قاتل عمدي، به هر دليلي، نظير رضايت اولياي دم يا نداشتن شاكي، قصاص نشود، مجازات حبس سه تا ده سال،كه در خصوص او، اعمال خواهد شداما در قوانين آمريكا ما ۳ درجه مجازات ۱ تا ۳ بامجازات متفاوت براي قتل داريم و مجازات اعدام در امريكا منسوخ و جا خودرا به حبس ابد داده است در قانون امريكا قتل نفس خودش بر دو نوع تقسيم بندي مي شود كه عبارتند از Murder كه قتل عمدي است و Manslaughter كه همان قتل غير عمدي است.
