بين تعاليم اسلام ومفهوم حقوق شهروندي ونيز بين هرسنت الهي ديگر با حقوق شهروندي رابطه ي گسست ناپذيري برقرار است.تعارضاتي كه گاه در سنتها با موارد حقوق شهروندي ديده مي شود از تعارضات آشتي پذير و قابل حل است . حقوق شهروندي جدا از حقوق فطري طبيعي و منفك از آن نيست وروح حاكم بر سراسر سنت الهي كه در عرف تجلي پيدا كرده است .با توجه به كرامت ذاتي انسان است كه پاي حق وحقوق به ميان كشيده مي شود و هر چه انسان اجتماعي تر ومدني تر مي شود،بر شعاع كرامت او افزوده مي شود واين شعاع ها همان حقوقي است كه از مخزن حقيقي به نام «كرامت»سر بر آورده اند.اصول اساسي حقوق بشر هم چون كرامت انساني، برابري انسان ها حيات انساني و آزادي انساني از دغدغه هاي اساسي در نظام حقوقي اسلام است . در همين راستا حقوق اسلامي مبتني بر دايره وسيعي از دستاوردهاي بشري است كه تاكنون كمتر به آن پرداخته شده است. اهميت قضاوت و استقلال قضايي دو مقوله حياتي در بدو شكل گيري حقوق اسلامي بوده است. در زمان پيامبر اكرم (ص) و خلفاء، استقلال قضايي از جايگاه ويژه اي برخوردار بوده و هيچ مقامي حتي خلفا حق دخالت در امر قضاوت را نداشته اند. در اين پاياننامه بعد از تعريف قضاوت در اسلام به اهميت امر قضا طبق آيات و احاديث پرداخته ميشود و سپس با اتكا به روايات مستند نمونه هايي از استقلال قضايي در عهد پيامبر (ص) و خلفاي راشدين ارائه ميگردد.

Conflicts that are sometimes seen in traditions with cases of citizenship rights can be reconciled and resolved. Citizenship rights are not separate from natural rights and separate from it, and the spirit that governs the entire divine tradition that is manifested in custom. It is according to the inherent dignity of human beings that rights and rights are raised, and the more social and civilized human beings are. The radius of his dignity is increased and these radii are the same rights that have emerged from the real reservoir called dignity . The basic principles of human rights such as human dignity, equality of human life and human freedom from the concerns It is fundamental in the Islamic legal system. In this regard, Islamic law is based on a wide range of human achievements that have been less studied so far. The importance of judgment and judicial independence have been two vital issues since the formation of Islamic law. In the time of the Holy Prophet (PBUH) and the caliphs, judicial independence had a special place and no official, not even the caliphs, had the right to interfere in the judiciary. In this dissertation, after defining judgment in Islam, the importance of jurisprudence according to verses and hadiths is discussed and then, relying on documentary narrations, examples of judicial independence in the time of the Prophet (PBUH) and the righteous caliphs are presented
