چكيده فارسي :
عهدنامه مودت با نام كامل عهدنامه مودت و روابط اقتصادي و حقوق كنسولي ميان ايران و ايالات متحده آمريكا يك سند حقوقي مي باشد كه ميان دولت ايران و ايالات متحده آمريكا در ۱۹۵۵ در تهران امضا شد اين عهدنامه در زمره اسناد حقوقي است كه دولت ها بر روابط خود با كشورهاي ديگر منعقد مي كنند در دوران قبل از انقلاب اسلامي ايران در دوران حكومت پهلوي روابط ميان ايران و ايالات متحده آمريكا در زمينه هاي مختلف شامل اقتصادي و نظامي و سياسي بسيار گسترده بود از اين رو به منظور تحكيم بخشيدن هر چه بيشتر به اين روابط عهدنامه هاي موسوم به عهدنامه مودت و روابط اقتصادي و حقوق كنسولي بين ايران و ايالات متحده آمريكا در سال ۱۹۵۵ ميلادي منعقد شد و به تبع انعقاد اين عهدنامه اشخاص حقوقي و حقيقي آمريكايي اقدام به سرمايه‌گذاري در ايران كردند( مقاله شماره ۴ صفحه ۲) هدف از انعقاد اين معاهده صلح استوار و پايدار و دوستي صميمانه ميان دو كشور ايران و آمريكا ميباشد كه تحقق اين هدف با گسترش تجارت و اقدامات تجاري و تسهيل كردن حقوق كنسولي و گمركي و حمل و نقل و غيره در راستاي عهدنامه حاصل مي گردد ( تقوي نژاد .1397. صفحه ۲ )در اختلافات بين المللي يكي از روش هاي حل و فصل اختلافات و روشهاي حقوقي مي باشد كه در اين روش براي حل و فصل اختلافات از مقررات و قوانين حقوق بين الملل براي حل و فصل اختلافات استفاده ميشود روش هاي حقوقي شامل داوري بين المللي و دادگستري بين المللي مي باشد( ضايي بيگدلي .1395. ۴۶۱)

The Treaty of Amity, also known as the Treaty of Amity, Economic Relations, and Consular Rights between Iran and the United States of America, is a legal document signed between the governments of Iran and the United States in Tehran in 1955. This treaty belongs to the category of legal documents that states enter into regarding their relations with other countries. During the period before the Islamic Revolution in Iran, during the Pahlavi regime, the relations between Iran and the United States were extensive in various fields, including economic, military, and political. In order to further strengthen these relations, the Treaty of Amity and Economic Relations and Consular Rights, known as the Treaty of Amity, was concluded in 1955. As a result of this treaty, legal and natural persons from the United States invested in Iran. The aim of this treaty is to establish a firm and lasting peace and sincere friendship between the two countries, which is achieved through the expansion of trade, commercial activities, facilitating consular and customs rights, transportation, and more in line with the provisions of the treaty. In international disputes, one of the methods of resolving disputes and legal methods is the use of international law regulations for dispute resolution. Legal methods include international arbitration and international judiciary.
