بررسي موانع و چالش‌هاي حقوقي سازمان‌هاي مردم‌نهاد در نظام حقوقي ايران

Study of Legal Barriers and Challenges of Non-Governmental Organizations in the Iranian Legal System

در عرصه داخلي و بين‌المللي سازمان‌هاي متعددي در زمينه‌هاي مختلف فعاليت دارند كه در اين بين موقعيت سازمان‌هاي غيردولتي در خور بررسي است. از جمله مهمترين بازيگران غيردولتي كه به دليل كاركرد مفيدشان مقرراتي راجع به نحوه تأسيس و فعاليت آن‌ها تدوين يافته، سازمان‌هاي مردم‌نهاد هستند. اين پژوهش درصدد تبيين موانع و چالش‌هاي حقوقي سازمان‌هاي مردم‌نهاد در حقوق ايران است. در نظام حقوقي ايران مقرراتي در زمينه تأسيس و فعاليت سمن‌ها تدوين يافته است كه موضوع اين پژوهش حول محور اين دو مرحله از مراحل وجودي سمن‌ها مي‌باشد. در واقع نظارت پيشيني در زمان تأسيس و نظارت پسيني در هنگام فعاليت سمن‌ها موضوعاتي هستند كه خود موانع و چالش‌هاي حقوقي سمن‌ها در حقوق ايران را به تصوير مي‌كشند. در صورت شناسايي شخصيت حقوقي براي اين سازمان‌ها اثر مهم داشتن سمت در اقامه دعوا كه واجد اهميت فراواني است قابل اعمال است، همچنين علي‌رغم وجود موانعي در شناسايي شخصيت حقوقي بين‌المللي براي سمن‌ها در عمل رويكردها به سمت شناسايي شخصيت حقوقي آن‌ها گرايش دارد. قانونگذار دادرسي كيفري در قانون مصوب 1392 گامي مهم در نقش قائل شدن براي اين سازمان‌ها جهت حضور در فرايند كيفري برداشته است. پيشنهاد مي‌شود قانوني جامع راجع‌به تأسيس و فعاليت اين سازمان‌ها تدوين يابد تا زمينه سهولت فعاليت آن‌ها فراهم گردد.

Study of Legal Barriers and Challenges of Non-Governmental Organizations in the Iranian Legal System Abstract Various organizations are active in the domestic and international arena, and the position of non-governmental organizations is worthy of investigation.Non-governmental organizations are among the most important non-governmental actors whose regulations regarding their establishment and operation have been formulated due to their useful function. This research aims to explain the obstacles and legal challenges of non-governmental organizations in Iranian law. In the legal system of Iran, regulations have been formulated in the field of establishment and activity of non-governmental organizations, and the subject of this research revolves around these two stages of the existence of non-governmental organizations.In fact, prior supervision at the time of establishment and posterior supervision during the activities of non-governmental organizations are issues that depict legal obstacles and challenges of non-governmental organizations in Iranian law.In case of identifying the legal personality for these organizations, the important effect of having a position in filing a lawsuit, which is very important, can be applied.Also, despite the existence of obstacles in the recognition of international legal personality for them, in practice, the approaches tend towards the recognition of their legal personality.In the law approved in 2012, the lawmaker of criminal proceedings has taken an important step in assigning the role of these organizations to participate in the criminal process.It is suggested that a comprehensive law regarding the establishment and activities of these organizations be drafted to facilitate their activities.
