بررسي دادگاه هاي نسل سوم و تأثير آن بر حقوق كيفري بين الملل

دادگاه های كیفری بین المللی نسل سوم، نوعی از دادگاه های كیفری بین المللی است كه تلفیقی از نظام حقوق كیفری بین الملل و نظام كیفری ملی كشور مربوطه است. در این پایان نامه قصد اصلی این می باشد كه مشخص نماییم تشكیل دادگاه های نسل سوم كه تركیبی از قضات و دادستان های ملی و بین المللی و تركیبی از حقوق این كشور ها و حقوق بین الملل می باشد، در تحولات كیفری بین الملل نقش مثبت و سازنده ای ایفاء كرده اند. تا كنون شش دادگاه كیفری بین المللی از نوع نسل سوم تشكیل شده است كه 1 تیمور شرقی - 2 كامبوج - 3 سیرالئون - 4 بوسنی و هرزگویین - 5 لبنان - 6 كوزوو ، كه هر كدام به نوعی شرایط ویژه ای داشته و سازمان - ملل متحد سعی نموده است با مذاكرات و امكان سنجی، دادگاه ی منطبق با آن شرایط را به وجود بیاورد. این دادگاه ها علاوه بر روند تكاملی نسل های سه گانه دادگاه های كیفری بین المللی دارای یك روند تغییرات مخصوص به خود نیز بوده اند به گونه ای كه آخرین دادگاه كیفری بین المللی نسل سوم كه دادگاه ویژه برای لبنان نام دارد تفاوت زیادی با سایر دادگاه های هم نسل خود دارد.

The Third generation of the international criminal courts are one of kind of the international criminal courts which are combination of international criminal law system and national criminal system of relevant country. My main purpose at the present thesis is discussing the positive and negative effects of the third generation of the international criminal courts that are the combination of national and international judges, prosecutors, domicile law of parties and international law. At this time we have the sex and more international criminal court which can be regard as the third generation of international criminal courts and a few of them active now and others finished its tasks, but all of that courts have and had special tasks and situations and established at the special time and for take part in the different matters and trail different crimes with special discretions. However the United Nations try to establish and assist to it by make best circumstance and according to current international law through negotiations and good faith. This sex international court that discussed at the present study have special and different processes for their evolution. For example Lebanon special court as last court of third generation of criminal court or hybrid courts have many distinctions and its special discretions with its counterpart courts.
