Abstract :
The provision of the ban on the company debt comes first on thedebates of the new Turkish Commercial Codeprovisions.The purpose of this arrangementisto prevent the poor and disabled application which is very common in commercial life and due to its size causes huge losses.In the many companies, shareholders reallyuse the company case for the many business and the processes including the capital commitments, make personal spendingthrough this and withdraw money from the company. Due to these applications, as the legal entity of the company is not a means and the creditors will be damaged also.With these reasons, on the new code, the company debt of the members of the company and the board of directors is limited. In this study, the application, scope and limitations of the ban on the company debtare examined.
