Abstract :
The current turkish Code of Commercial came into force in 01.07.2012. Although, the provisions, which are about commercial litigation and commercial courts, are issued in TCC (TTK in turkish), they are, in fact, procedural provisions. As a rule, procedural provisions are issued in Code of Civil Procedure (HMK in Turkish). However, it is possible that procedural provisions can be issued in other codes. This article is about provisions of commercial litigations and commercial courts that are issued in the current TCC. In this context, primarily, it is focused on commercial litigation, examined that if there exists any difference between prior and current Code of Commercial about which litigations are commercial or not and varieties of commercial litigation are put forward. Afterwards, courts, which can handle commercial litigations, are dealt and the nature of the relationship between the court of first instance and the commercial court of first instance according to the new TCC are analyzed.
