Abstract :

With the crime of making himself deliberately useless for military service which has been regulated in the 79th article of the Military Criminal Law in 1930, it is aimed to guarantee to execute on time the military service obligation and the permanance of military service arised from this obligation in accordance with the honest, fair and equality princibles by all people determined by law. As a matter of fact, in the above-mentioned article, the people at military age who mutilate yourself deliberately or make yourself useless for military services thus any are envisioned to be punished. In the 80th article of the Military Criminal Law in relation with this crime, the people at military age who perform to the others deliberately the same acts written in the 79th article are envisioned to be punished with the same penalty. The 79th and 80th articles of the Military Criminal Law will be analysed together due to the connection between them. The authority for judging this crime will be determined according to the perpetrator of the crime, for instance, whether the perpetators and their accompliences are soldiers or civilians.
