Offense of providing location and facility for gambling is regulated in article 228 of the Turkish Penal Code, as one of the offenses against public morality. Legislator aimed with this type of offense to prevent the uncontrolled spread of gambling in the society. Both movements in the form of the providing location and providing facility must be carried out to occur the offense. If only one of them is realized, the offense does not occur. Furthermore providing location and facilities must be oriented to the playing gambling in terms of spiritual element. For this reason the offense can be committed only by the special intent, which occurred in this way.
