Crime of Causing Noise in Turkish Criminal Code
Abstract :
The traditional definition of noise is “unwanted or disturbing sound”. Noise pollution adversely affects the lives of millions of people. Studies have shown that there are direct links between noise and health. Noise pollution is the environmental problem, and the effective management and control of noise is the part of the environmental policy. Criminal law has an important part to play in protecting the environment; in this context states adopt provisions of the act, aiming at the protection of the right to life and health of human - the right to environmental healthines- under its domestic law. The unlawful causing of noise; has adopted as criminal offences in Turkish Criminal Code In this article, firstly the concept of noise is analyzed. Then, the approach of the European Union Policy and European Court of Human Rights’ judgments about noise are mentioned. Finally, taking into account to the judgments of the Supreme Court of Appeals and theory, causing noise, offences against the environment in Turkish Criminal Code, is explained.
