Abstract :
According to the 10th article of the Higher Education Law no: 2547, higher education institutions that are established by foundations are obliged to submit their studies to the Higher Education Council at the end of each academic year. Just like public higher education institutions. These institutions are under supervision, and have regular audits by the Higher Education Council. These audits occur in regards to fiscal, administrative and economic issues. Law enacts the details and principles of the authority that supervises and creates audits. Its prescribed by the Regulation of Foundation Higher Education institutes. Neither the principles for the audit done by the Higher Education Council, or the criteria for imposing sanctions in consequences of the audit, are enacted in detail within the law. The law numbered 2547 mentions only information on the inadequacy of education and training. Furthermore problems arise when inadequacy occurs, as this is also undeclared in the Regulation of Foundation Higher Education Institutes. For this reason, there is necessity to enact the auditable criteria’s in a separate law regarding the universities that are created by the foundations and public universities. It should define objectives and determinable criteria’s such as: the number of academic members that is necessary for education and training; the level of training academic members and researchers should receive; the structure of how the classrooms and laboratories should be; and lastly how the publications and research should occur. There are similar criteria’s in article 18-law number 2547, which is about grant-in-aids (Government Support). There is a need to clarify the inadequacy created in the education and training section. Whether this is created by a new regulation or by referring to the 18th article of the law numbered 2547. By this means the universities that are created by foundation can engage their activities within the law. Also by this mean the Higher Education Council will be able to conduct audits with objective criteria’s. Finally judicial review will be easier once clarification occurs within this section.
