Protection of Children from Violence Under Civil Law Rules
Abstract :
In terms of private law, violence signifies the uninvited intervention to one’s personality rights and patrimonial assets. At this regard, children’s protection from violence constitutes an important subject and it is regulated under different legal rules. Some of the general provisions Turkish Civil Code may be taken into account in accordance thereof. Hence, provisions regarding the protection of personality rights, legal guardianship and exceptionnally tutorship deal with protection of children either from third persons or from guardian/tutor when they have misused their authority. This article aims to examine the mentioned provisions with regard to the children’s proctection from violence.
