Abstract :
Surrogacy has already been subject of many academic studies. Its complex structure touching diverse disciplines such as sociology, ethics, biology and law keeps drawing more and more attention everyday. The article aims to elaborate the surrogacy in light of the recent European Court of Human Rights’ decisions and give a brief comparative overview. Contrary to the common belief, surrogacy is not banned in Turkey; yet problematic in practice. Nevertheless, legal systems must adapt to scientific developments and seek to satisfy each and every individual. Accordingly, instead of hiding behind ambiguous concepts such as morality and public order, the law must be rendered suitable and welcoming for surrogacy.
