LOCAL EFFECT OF GLOBAL HUMAN RIGHTS: A BRIEF EXAMINATION ON THE EXPLANATORY APPROACHES
Abstract :
The human rights concepts and principles inscribed in the Universal Declaration of Human Rights proclaimed by the General Assembly of the United Nations on 10th December 1948, have become, especially since 1970s, globalized thanks to the argument that “human rights are universal”. This article examines some key theoretical approaches dealing with the processes through which global human rights concepts, principles and norms are transferred into national laws. The article discusses the classification of these theoretical approaches dealing with the effects of global human rights standards on nation states which may be defined as “local points”, considering the globalization phenomena. The theorization of the processes through which the transfer of the global human rights concepts and principles that were systematized and codified internationally soon after World War II took place on national level may be helpful in explaining when and how international human rights pressure on nation states would be successful. Such theoretical frameworks may also provide practical insights for understanding how some nation states can actually resist to international human rights pressure while others cannot. By examining some key theoretical approaches on this matter, the article tries to provide its readers such practical insights.
